1. General Terms
1.1 Welcome to KoKonna AI E-ink frame hardware and its companion mobile application (the “App”) provided by Shenzhen Galaxy Guide Technology Co., Ltd. (“we” or the “Company”). These services are collectively referred to as the “Service”.
1.2 Please read this End User License Agreement (“this Agreement”) carefully, especially the parts that significantly affect your rights. By downloading, installing, or using the App, or by activating, connecting, or using the electronic frame hardware, you acknowledge that you have read, understood, and agree to be bound by this Agreement and the Privacy Policy.
2. Account Registration and Management
2.1 You need to register an account to use core features. You undertake to provide true, accurate, and complete registration information and to keep it up to date.
2.2 You are responsible for all activities under your account and for safeguarding your password. If you discover any unauthorized use, you must notify us immediately.
2.3 We may, as required for operations, ask users to complete real-name verification.
3. Service Usage Guidelines
3.1 Lawful Use: You agree to comply with all applicable laws and regulations when using the Service and not to engage in any illegal, infringing, or unethical activities, including but not limited to:
- Uploading, generating, or displaying content that is obscene, pornographic, violent, terror-related, gambling-related, defamatory, invades privacy, or infringes intellectual property (e.g., unauthorized copyrighted works, portrait rights).
- Interfering with or disrupting the normal operation of network services or hardware devices.
- Accessing other people’s accounts or devices without permission.
3.2 Content License: For content you upload or generate via AI, you warrant you hold the relevant rights or have obtained lawful authorization. You grant us a worldwide, royalty-free license to store, process, and transmit such content to provide the Service (e.g., synchronizing images to your frame).
3.3 Hardware Use:
- Use the electronic frame in accordance with the product manual and safety guidelines; avoid using it in humid, high-temperature, or otherwise harsh environments.
- The hardware product is covered by a separate limited warranty as detailed in the product manual.
- The Service requires a stable Wi-Fi connection. We are not liable for interruptions or delays caused by your network conditions.
4. AI-Generated Content Disclaimer
4.1 AI generation features produce content automatically based on algorithms and models; results are uncertain and may vary. We do not guarantee the safety, accuracy, legality, or fitness-for-purpose of generated content.
4.2 You bear full responsibility for the prompts you input and for your use of the generated content. We do not endorse any views expressed by AI-generated content.
4.3 In some jurisdictions, AI-generated content may not be eligible for independent copyright. Please follow local laws regarding ownership and rights.
5. Intellectual Property
5.1 All intellectual property in KoKonna AI hardware, the App, software, trademarks, UI/UX designs, and documentation belongs to us or our licensors.
5.2 This Agreement does not grant you any of the above rights. Without our written consent, you may not copy, modify, reverse engineer, or create derivative works.
6. Disclaimer and Limitation of Liability
6.1 We provide the Service on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim any express or implied warranties regarding continuity, error-free operation, merchantability, or fitness for a particular purpose.
6.2 We and our affiliates/partners shall not be liable for any direct, indirect, incidental, punitive, or consequential damages (including data loss, lost profits, or business interruption) arising from:
- Force majeure (e.g., natural disasters, war, government actions).
- User misuse, network issues, or failures of third-party services.
- User violations of this Agreement or applicable laws.
- Any other circumstances where liability is excluded by law.
6.3 In all cases, our total liability to you shall not exceed the amount you paid for the product or Service giving rise to the claim.
7. Changes and Termination
7.1 We may modify this Agreement and announce changes through the App or our website. If you disagree, you may stop using the Service; continuing to use it constitutes acceptance.
7.2 You may terminate the Service at any time by deleting your account. We may suspend or terminate Service if you materially breach this Agreement.
8. Governing Law and Dispute Resolution
8.1 This Agreement’s formation, performance, and interpretation, as well as dispute resolution, are governed by applicable law.
8.2 Any disputes shall first be resolved amicably through negotiation; failing that, either party may file suit in a court with jurisdiction where the Company is registered.
9. Miscellaneous
9.1 This Agreement and the Privacy Policy constitute the entire agreement between you and us regarding the Service.
9.2 Our failure to enforce any provision shall not be deemed a waiver of rights.
